1. Use of Our Service

1.1 Specification of terms

Your use of the online design service, products, software and web sites (referred to as “Services” hereafter) provided by Swiftlayout ApS (referred to as Swiftlayout hereafter) presupposes your acceptance of the following, legally binding agreement of terms between Swiftlayout and you.

1.2 Acceptance of terms

You accept the terms by clicking to accept or agree to the terms, when ever this option shows up in the user interface of Swiftlayout or simply by your continued use of the Services. In this case, you understand and agree that Swiftlayout will treat your use of the Services as acceptance of the terms from that point onwards.

1.3 Age limit of users

You are not eligible to use the Services of Swiftlayout if you are under 18 years of age unless you are supervised by an authorized adult (i.e. parent, guardian or teacher) who accepts to the terms of use.

2. Specification of Services

Swiftlayout is an online, template-based graphic design tool where you can customize and create your own layouts of graphical material like flyers, photo books, business cards etc. and order it for print. You can also download a low-res watermarked pdf-file of your layout at any time. After your print purchase of any completed design, you’ll be able to download a high-res pdf-file of your design.

Swiftlayout includes the subsidiary entity SeasonBooks.com.

3. Personal Data

3.1 Use of your personal data

Personal data is collected through forms on our website which you yourself have submitted. We ask for your email address for login purposes and you consent to our using the email address to send you Service-related notices, including any notices required by law, in stead of communication by postal mail. Your mailing address is stored for the purpose of creating invoices.

Your personal data is stored as long as you have an account with Swiftlayout.

3.2 Access to your personal data

3.4 Personal data integrity

In creating a swiftlayout account, you confirm to Swiftlayout that your personal data are accurate and authentic. Swiftlayout reserves the right to bar access to or remove accounts where we have a substantiated suspision that this is not the case.

3.5 Third-party service

By accessing Swiftlayout with a third-party service, you give us permission to access and use your information from that service as permitted by that service, and to store your log-in credentials for that service.

3.6 Use of other peoples/entities accounts

You may never use another user’s account without legally verifiable permission from that user. You alone are responsible for the activity on your account and for the confidentiality of your log-in credentials. You must notify Swiftlayout immediately on of any breach in security or potential unauthorized use of your account. Swiftlayout reserves the right, but is not obligated to bar access to or remove accounts at any time in which activity occurs which Swiftlayout deems questionable or out of harmony with our terms of use.

4. Usage Rules

4.1 Web scraping

You hereby agree that you’ll never engage in any activity which could be classified as “web scraping” or “data scraping” while accessing our Services or interacting with our web sites.

4.2 General usage behaviour

You agree that you’ll never make use of any automated system or function that will interact with our Services in a way that sends more inquires to our Swiftlayout servers than would be expected from a human being.

5. Printing Services

5.1 Mistakes in the pdf-file

Swiftlayout recommends that you review all design work before you place an order to avoid any issues with the finished printed product. If the issue(s) is/are present in the pdf-file produced by the Swiftlayout system which you had the opportunity to carefully review before printing i.e. by downloading and reviewing a free high-resolution proof pdf-file, then it shall not be considered a defect or mistake caused by the Swiftlayout system and Swiftlayout will not be responsible for any direct or indirect financial loss caused by the issue(s) i.e. the need of reprinting of the design work.

5.2 Delivery times

Standard delivery time from time of purchase to delivery is normally 7-10 days. Swiftlayout does not guarantee delivery dates and will not provide refunds for orders that arrive after the estimated delivery window unless a special written agreement has been made between you and the shipping department at Swiftlayout that has not been honored.

6. Content Policy

6.1 Content

Swiftlayout reserves the right to cancel and refund orders which contain one of more of the following content categories:

  • Pornography or child abuse
  • Violence or acts of terrorism or calls for the same
  • Promotion or advertisement for alcoholic beverages or tobacco

6.2 Templates

Swiftlayout reserves the right to modify a copy of all your designs in our system and make it/them available as swiftlayout templates for other users of the system. The modification always includes removal of any and all registered trademarks and the complete exchange of your text and images with neutral text and images which cannot in any way be traced to your company or person.

7. Security

7.1 Storage and Backup

Your personal data and provided layout data is stored in a relational database. Swiftlayout does its best to utilize the latest encryption algorithms and using industry standards for storing and handling information.

Backups are taken daily and each database backup is stored for 90 days. Backups are encrypted with a public key located on the server. Decryption is only possible with the private key that is securely stored off-site and unaccessible from the Internet. Backups are transferred securely to an off-site location.

7.2 Credit card information

We use only companies which practice secure processing of online funds so that you, as a potential customer, can be assured that your private information will be safe and secure.

Swiftlayout does not have access to credit card numbers. Only the credit card processing company has access to this information to complete the checkout process.

7.3 Disclaimer

Swiftlayout cares about the integrity and security of your personal information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. Should a data breach ever occur Swiftlayout will notify the local authorities within 72 hours. If the data breach puts your personal data at risk you will be notified as well.

8. No Warranty

The Services is provided on an “as is” and “as available” basis. Use of the service is at your own risk. To the maximum extent permitted by applicable law, the service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Without limiting the foregoing, Swiftlayout do not warrant that the content, including without limitation User Content and Stock Media, is accurate, reliable or correct; that the Services will meet your requirements; that the Services will be available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected; or that the service is free of viruses or other harmful components. Any content downloaded or otherwise obtained through the use of the Services is downloaded at your own risk and you will be solely responsible for any damage to your computer system or mobile device or loss of data that results from such download or your use of the service.

9. Law

As a company Swiftlayout is at all time subject to Danish corporate law. By your use of the Services that Swiftlayout provides, you agree to conform to this law at all times.

Swiftlayout also acknowledges your rights under the General Data Protection Regulation and will comply with the regulations.

10. Notification Procedures and Changes to the Terms of use

Swiftlayout may provide notifications required by law to you via email notice, written or hard copy notice, or through posting of such notice on our website, as determined by Swiftlayout in our sole discretion. Swiftlayout reserves the right to determine the form and means of providing notifications to our Users, provided that you may opt out of certain means of notification. This will require a deliberate action from you. Swiftlayout is not responsible for any automatic filtering you or your network provider may apply to email notifications we send to the email address you provide us. Swiftlayout may, in its sole discretion, modify or update this Terms of use from time to time, and so you should review this page periodically. When we change the Terms of use in a material manner, we will update the ‘last modified’ date at the top of this page. Your continued use of the Services after any such change constitutes your acceptance of the new Terms of Use. If you do not agree to any of these terms or any future Terms of Use, do not use or access (or continue to access) the Services.

11. Payment

11.1 Billing information

All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current.

11.2 Invoices

Payment of invoices from Swiftlayout are due 8 days after the issue date on the invoice. Delinquent payments may bear interest at the rate of one-and-one-half percent per month (or the highest rate permitted by law, if less) from the payment due date until paid in full. You will be responsible for all reasonable expenses (including attorneys' fees) incurred by Swiftlayout in collecting such delinquent amounts, except where such delinquent amounts are due to Swiftlayout’s billing inaccuracies.

11.3 Credit card

You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, licenses, royalties, transactions, or other monetary transaction interactions.
